Nors Care AS is subject to, and abides by, Norwegian legislation, including legislation and other legal framework conditions in the field of privacy, health and copyright. All questions that arise in connection with the content and use of the solutions are governed by Norwegian law. Any disputes will be settled by the courts in Norway. Nors Care AS is owner of the Nørs app, and owns, has copyright, trademarks and all other intellectual property rights related to the app, as well as the products and services mentioned on the website – with the exception of third parties.

Nors Care AS wishes to convey reliable and up-to-date information from reliable sources. All of our content provides source references. We have our own guidelines for the quality of content, and our healthcare staff have reviewed the content.

Nors Care AS is not a medical aid. We have no control over how you use the app. You are solely responsible for the decisions you make based on the content and tools in the app. You must never make decisions based on the app alone, and must consult a midwife, nurse or doctor if you are unsure.

Nors Care AS cannot guarantee that all the information is complete, sufficient, accurate or up to date.

Nors Care AS strives to be a safe and important supplement to the follow-up provided by healthcare professionals, but will never replace it. Links to external websites may be included in our solutions to make relevant information readily available. Such websites and associated content are subject to their own terms of use set out on the respective websites.

Nors Care AS takes no responsibility for the content or terms of use of such external websites.

Terms and conditions for the use of Nørs+

The Nørs App is basically free for everyone to use. Users of the app can purchase the subscription service Nørs+ (hereinafter referred to as the Service). This Service is optional for users of the Nørs App and can be purchased in the app. The terms described here are linked to the payment service Nørs+.

1. Content of the Service

As a user of Nørs+, you get access to tools such as pelvic floor training, baby logs, etc. You can read more about the features you can access in the app. Nors Care has the right to change the Service and the content of the Service if it incurs no extra cost for the user and Nors Care has a valid reason for the change. Nors Care has a valid reason if the change occurs due to adaptations to a new technical environment, to an increased number of users or other important operational reasons, to improve the user experience of the Service, to add new features to the Service or to change/update existing features. Nors Care will provide information about changes in accordance with mandatory law.

2. Access to the Service

Although it is Nors Care's ambition, Nors Care cannot guarantee that the Service will be delivered without technical interruptions. It may be necessary at times to restrict access to the Service due to, for example, service, support, security or technical reasons. Should any problems arise with the Service, or if the User is in any way dissatisfied, the User should contact Nors Care as soon as possible by emailing post@norscare.com. Nors Care always strives to find a solution to every problem as soon as possible. In the event of a problem with the Service, the User shall, to the extent that can be considered reasonable, cooperate with Nors Care to determine whether it is the User's hardware, software or network connections that are causing problems with the Service. The duty of cooperation is limited to the technically available means that are least intrusive for the User.

3. Price and cancellation

We offer Nørs+ as an annual or monthly subscription. Current prices are available in the app. You can cancel the subscription at any time, and it will continue until the next subscription period. It is easy to cancel a subscription by going to My Profile in the app or through Settings on your phone. An annual subscription gives a discounted price in relation to a monthly subscription for 12 months.

REFUND IN THE EVENT OF TERMINATION OF PREGNANCY

A subscription can normally be cancelled according to the terms described further down this page. An exception to this is if you choose an annual subscription, and you no longer use Nors Care due to a termination of pregnancy. Nors Care will then refund the remaining amount during your subscription period. To get a refund, you must contact us here.

4. Intellectual property rights

Nors Care or Nors Care's licensors own all rights, including intellectual property rights related to the Service. The User does not acquire any intellectual property rights or other rights to the Service through these Terms of Use. Provided that the User complies with these Terms of Use, the User receives a non-exclusive and non-transferable right to use the Service during the term of the agreement. The User may not print or otherwise make copies of the content.

5. Liability

The User is responsible for their use of the Service. Except as expressly provided in this Agreement and mandatory law, Nors Care has no obligations or warranties regarding the functionality and content of the Service. In no event shall Nors Care be liable for any loss of profits, revenues, savings, goodwill, loss due to business, power or network interruptions, loss of data, your potential liability to third parties or indirect losses or consequential damages of any kind.

6. Requirements of the User

The User is responsible for ensuring that the use of the Service is not illegal. Nors Care complies with Norwegian law and has the right to remove anything that is inappropriate or illegal in any way, as well as the right to exclude Users who use the Service in an illegal manner, or that Nors Care deems inappropriate. If you are found to be using the Service in violation of these Terms of Use, you are obliged to compensate Nors Care for all reasonable costs and expenses, as well as any losses Nors Care incurs in connection with such use. Nors Care has the right to exclude the User if Nors Care has reasonable grounds to suspect that the User is misusing the Service, using it in violation of these Terms of Use or, in contact with other Users, acts, for example, in an offensive or otherwise inappropriate manner. Nors Care has the exclusive right to consider when a User, as a result of his or her behaviour when using the Service, should be excluded. Such exclusion should not be seen as Nors Care's failure to provide the service.

7. Terms and conditions for downloading via App Store and Google Play

In order for us to be able to provide the Service through App Store and Google Play, Apple and Google, respectively, require you, as a User of the App, to comply with special terms for the benefit of Apple and Google, respectively, which you agree to through these Terms of Use.

7.1 You agree that these Terms of Use are only between you and Nors Care and not between you and Apple and Google, respectively.

7.2 You agree that Nors Care is solely responsible under these Terms of Use for responding to any claims made by you or others regarding the App or your possession and/or use of the App.

7.3 You agree that neither Apple nor Google has any obligations with respect to maintenance and support services for the App. In the event of errors or performance issues, please contact Nors Care directly, which is responsible for maintenance and support of the App.

8. Special terms for Apple (iOS users)

Apple is not a party to these terms, is not the owner and is not responsible for the app. Apple does not provide any warranty for the App except, if applicable, to refund the purchase price for it. Apple is not responsible for maintenance or other support services for the App and shall not be liable for any other claims, losses, liabilities, damages, costs or expenses with respect to the App, including any third-party product liability claims, claims that the App does not comply with applicable legal or regulatory requirements, claims arising under consumer protection or similar legislation, and claims with respect to intellectual property infringement. Any inquiries or complaints related to the use of the App, including those regarding intellectual property rights, must be addressed to Nors Care. The licence granted to you in these terms is limited to a non-transferable licence to use the App on an Apple-branded product that runs Apple's iOS operating system and is owned or controlled by you, or is otherwise permitted by the usage rules in the Apple App Store's terms of use. In addition, you must comply with the terms of any third party agreement that applies to you when using the App, such as the wireless data service agreement. Apple and its subsidiaries are third-party beneficiaries of these terms, and when you agree to the terms and conditions therein, they will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of these terms. Notwithstanding these rights to Apple and its subsidiaries, Nors Care's right to enter into, revoke or terminate any modification, waiver or settlement under these terms is not subject to the consent of any third party.

MANAGING THE SUBSCRIPTION FOR IOS USERS: Recurring billing, but you can cancel at any time. Payment will be charged to your iTunes account upon confirmation of purchase. Subscriptions are automatically renewed unless auto-renewal is turned off at least 24 hours before the end of the applicable period. Your account will be charged for renewal within 24 hours of the end of the current period, and the renewal price will be set. The subscription can be managed by the User. Auto-renewal can be turned off by going to settings after purchase. The current subscription can be cancelled at any time, and the subscription will then be active for the current period.
